Welcome to Lumiwee. In these Terms, "we," "us" and "our" mean Lumiwee. Lumiwee runs this store and website, including all related information, content, features, tools, products and services (together, the "Services"). Lumiwee is powered by Shopify, which enables us to provide the Services to you.

By visiting our store, creating an account or buying from us, you agree to these Terms of Service ("Terms") and to the policies they reference, including our Privacy Policy, Return & Refund Policy and Shipping Policy. If you don't agree, please don't use the Services. You must be at least 18 years old, or the age of majority where you live, to place an order.

1. Accounts

You're responsible for keeping your account and password secure and for all activity under your account. Please give us accurate, current and complete information, and let us know right away if you suspect unauthorized use. We may refuse service or close accounts at our discretion.

2. Our Products

Lumiwee offers baby and little-kid essentials: nursery, feeding, bath, clothing, play and on-the-go products for families. We work to show colors, sizes and details accurately, but screens vary and product photos may include styling items that aren't sold with the product. Measurements are approximate. We may change or discontinue products at any time.

3. Product Use and Child Safety

Please read and follow every instruction, warning and age recommendation that comes with a product, and always supervise your child when a product is in use. Check items before each use and stop using anything that is worn or damaged. Our products are not medical devices and are not intended to diagnose, treat or prevent any condition. Photos and descriptions are not a substitute for the product's own safety instructions.

4. Orders

Placing an order is an offer to buy the items in your cart. We may accept, decline, cancel or limit any order, including orders that appear to be placed by resellers or that show signs of fraud. An order is accepted only when we confirm it and receive payment. Please check your order details, especially your shipping address, before you pay.

5. Prices and Payment

Prices are in U.S. dollars and may change at any time. If an item is listed at an incorrect price because of an error, we may cancel the order and refund you. You agree to provide current, complete and accurate billing information and authorize us, through our payment processors, to charge your payment method for your order.

Chargebacks and Payment Disputes

If you have a problem with an order, including a delay, a damaged or incorrect item or a billing question, you agree to contact us first at hello@lumiwee.com and give us a reasonable chance to resolve it before starting a chargeback or payment dispute with your bank or card issuer. We keep order records, proof of delivery and customer correspondence, and we may use them to respond to any dispute.

6. Shipping and Delivery

Shipping details, including estimated delivery times, are described in our Shipping Policy. All delivery times are estimates and not guarantees. Lumiwee isn't responsible for delays caused by carriers, incorrect address information, high order volume, weather or other events outside our control. You're responsible for entering a correct and complete shipping address. Once an order is marked delivered to the address provided, responsibility for the package passes to you. If a package is delayed, lost or marked delivered but not received, contact us at hello@lumiwee.com and we'll help.

7. Returns and Refunds

Returns, refunds, exchanges and non-returnable items are covered by our Return & Refund Policy, which forms part of these Terms.

8. Intellectual Property

All content on this site, including text, images, graphics, logos, product descriptions, videos and site design, belongs to Lumiwee or its licensors and is protected by intellectual property laws. You may use the Services for personal, non-commercial shopping only. You may not copy, reproduce, sell or exploit any part of the Services without our written permission. The Lumiwee name, logo and branding are our property and may not be used without permission. Shopify's name and marks belong to Shopify.

9. Third-Party Tools and Links

We may provide access to third-party tools, services or websites that we don't control. They are provided "as is," and your use of them is at your own risk and subject to their own terms. We're not responsible for third-party content, products or practices.

10. Relationship with Shopify

Lumiwee is powered by Shopify, but any purchase you make through our store is made directly with Lumiwee. Shopify is not responsible for any part of the sale between you and Lumiwee, including any injury, damage or loss resulting from purchased products, and you release Shopify and its affiliates from claims related to your purchases from us.

12. Reviews and Feedback

If you send us reviews, photos, ideas or other feedback, you give Lumiwee a perpetual, worldwide, royalty-free license to use, reproduce, publish and display it in any media. You confirm that your feedback is your own, is accurate and doesn't violate anyone's rights. Please don't include photos that show a child's full name or other identifying details.

13. Errors and Omissions

Our site may occasionally contain typos, inaccuracies or omissions in product descriptions, pricing, promotions or availability. We may correct them and update information at any time without notice, including after an order has been placed.

14. Prohibited Uses

You may not use the Services for any unlawful purpose; to infringe anyone's rights; to harass or harm others; to submit false information; to upload viruses or malicious code; to scrape or collect data without permission; to interfere with the site's security or operation; or in any way that could harm Lumiwee, Shopify, our customers or other users.

15. Termination

These Terms apply until ended by you or us. We may suspend or end your access to the Services at any time if we believe you've broken these Terms. Obligations that arose before termination survive it.

16. Disclaimer of Warranties

Except where the law says otherwise or as we expressly state, the Services and all products are provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don't guarantee the Services will be uninterrupted, secure or error-free.

17. Limitation of Liability

To the fullest extent permitted by law, Lumiwee and its owners, employees, partners, suppliers and service providers, and Shopify and its affiliates, won't be liable for any indirect, incidental, special, punitive or consequential damages arising from your use of the Services or any product, even if advised of the possibility. Where liability can't be excluded, our total liability is limited to the amount you paid for the product at issue.

18. Indemnification

You agree to indemnify and hold harmless Lumiwee, Shopify and their affiliates, partners, employees and service providers from any claim or demand, including reasonable legal fees, arising from your breach of these Terms, your violation of any law or the rights of a third party, or your misuse of the Services.

19. Severability

If any part of these Terms is found unenforceable, that part will be enforced to the fullest extent allowed and the rest of the Terms stay in effect.

20. Entire Agreement

These Terms, together with the policies they reference, are the entire agreement between you and Lumiwee about the Services and replace any earlier agreements. Our failure to enforce any right isn't a waiver of that right. Any ambiguity will not be interpreted against us as the drafter.

21. Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may assign ours without restriction.

22. Governing Law

These Terms are governed by the laws of the State of New York, United States, without regard to conflict-of-law rules. You and Lumiwee agree to the jurisdiction of the courts located in the State of New York.

23. Changes to These Terms

We may update these Terms at any time by posting the new version on this page with a new "Last updated" date. Continuing to use the Services after a change means you accept the updated Terms.
